Colin’s is a very famous clothing brand in Europe and the Middle East, but it’s clear that the ownership and use of this domain is very personal, hence constitutes fair use. Let’s hope the owner will actually respond to this UDRP.

The domain name was first captured by Wayback Machine in 1998 and I have not found any parked pages ever used on the domain name. I’m very interested in knowing why a UDRP complaint has been filed against the domain name owner.

I see this as an abuse of the UDRP or the complainant knows little about internet laws.

I registered this domain name for my son, Colin, when he was just a few years old so he could use it when he got older. I responded to the UDRP filing in a timely and correct manner. We have never violated any UDRP WIPO rules.

FYI, the complaint was denied and my son will be able to continue to use the domain name colins.com for personal reasons and email. Hopefully the Complainant will not pursue this further.
The panel found that the complainant was able to establish only the first of the 3 points:
1. Confusingly similar to a trademark – Complainant point accepted.
2. Legitimate right – the Respondent has a legitimate right – Complainant point DENIED
3. Used in Bad faith – No. The Respondent is using the domain name in good faith – complainant point DENIIED

I’m glad I took the time to fight this.
If the Complainant still wants to use colins.com, I would encourage them to contact me directly to see if there is something mutually agreeable we can do so they don’t feel we are causing each other any problem or hardship. We had tried to work with them before without involving legal steps. Maybe now we can continue to work in good faith to come to some agreement.
