Gucci this morning Won a UDRP seeking 165 domain names which all contain the famous trademark.
The complaint was filed by the formal name of the company that owns the trademark to the Gucci brand, Guccio Gucci S.p.A.
Many of these domains make no sense and its hard to believe that they would even get enough traffic to cover registration fees.
Domain names like guccihomeequity.com or guccijudo.com, guccihomesecurity.com, and guccihomeschooling.com
Many of the domains contain the famous trademark of another company as well and could have been actionable by two companies, I refer to them as double lawsuit domains, like yahooallguccihandbags.com and gucciyahooblog.com
All the domain names were owned by a Wode of Hong Kong

spot checked a couple of the domains. They were registered in January.
What do you think the odds were that whoever registered these would not have renewed them? No one else would have likely registered them.
Gucci may have been better off waiting till next year to see whether the domains deleted on their own.
In addition to paying the fees for the UDRP, is Gucci now going to pay the reg-fees on these 165 domains indefinitely?
This problem may have gone away on its own, but now Gucci may be out tens of thousands of dollars in order to own a bunch of worthless domains that no one would ever have seen or visited.

Lawyers do need to justify their fees, I think it also shows that even big companies fail miserably at protecting PRO-actively their IP, not every Fortune 500 is a Markmonitor et al client.
If I remember correctly there is a huge ‘Adidas’ typo that has been WIPO-ed twice after recuperating the domain the company forgot to renew the domain …

This problem would probably have gone away on its own. Instead these 165 domains are going to be added to the official stats as evidence of widespread cybersquatting.
The problem with cybersquatting is consumer confusion. But if no consumer ever sees a domain, even if it includes a TM, then is it cybersquatting?
A domain version of ‘if a tree falls in a forest and no one hears it, does it make a sound?’
