Less than two weeks after the .PW registry went live for domain name registrations, the first UDRP on a .Pw has been filed.
The .PW Registry went live on March 25th.
A UDRP complaint was filed with the National Arbitration Forum by Morgan Stanley over the domain name morganstanley.pw
The domain name is not currently resolving.
Of course the question I have is if Morgan Stanley didn’t elect to pay the Sunrise fee for a .PW domain name why are they willing to pay many times the cost just a few weeks later to get the domain name transferred to them.

Why should a famous TM holder be forced to pay for protection in every new turd extension?
There are two options –
1.) Pay a registry to register their obvious famous TM. The registries make money playing on the TM fears, like .XXX did, in what is basically a legal extortion scheme (protection racket).
2.) Go after the squatter after they registrar their TM.
Either option is not very appealing. Now multiply that x 1000 new extensions.

I guess the choice is to pay the registry extortion fee upfront or bury the ahole that registered your trade name later. It’s probably more fun for these companies to f@$k with these schmucks legally and avoid paying the sunrise ransom.
This is the approach they should take from a long term perspective. Don’t play the registry game and make it a losing proposition for anyone who registers trademark names thus deterring such registrations. They should publish the names of these trademark squatters and end the registry scam. Anyone running these registries is basically making money off others’s trademarks by selling them back to the rightful owners. Scum move. With all these new gTLDs coming out, they’re all counting on this easy money. It’s a joke.

Why do I have to pay $20K a year in real estate taxes which are used almost exclusively to support public schools when I don’t have any children?
So wishing it away isn’t going to make it go away.
If a brand is willing to pay $1,500 plus its attorneys costs to recover a domain that’s not even 2 weeks old then the made a bad business decision to not spend the $100 to get the domain during Sunrise.

Is it a better decision to reward a registry for selling TM domains to the TM owners? That is debatable. I guess it boils down to which squatter you want to pay.

If the case stops further cybersquatting by the same party, it might end up being a good decision.
Also, I think many of these TM holders are just going to refuse to play the protection racket game. What is the point of an extension like .sucks? To sell protection to TM holders.
I would not be surprised to see business interests actually go after specific extensions legally if we see any more “Protect your Brand” BS like .XXX did.

I’m not sure that argument works. Though you may not receive any direct benefit from those taxes I would imagine that the value of your home is higher as a result of having a well-financed school system since many families with children take that into consideration when selecting neighborhoods. So, you’ll see the return if and when you choose to sell. If those schools were sh$tholes, no one would want to live there. You’d have uneducated, delinquent kids, and higher crime. It’s a fact that a good school system raises property values.

However, a lawyer scans the list… do you think he will warn MorganStanley beforehand? Of course not, he will wait till two weeks after sunrise, then advise MorganStanley that some heathen from hell has dared to violate their inner sanctum and proceeds to bill them…
This really is a modern day protection racket. The difference nowadays is that BOTH side are playing it. TMs are certainly a bona fide protection racket but now namespace Dons are threatening loss of reputation to TMs that don’t play the game and pay their dues…
The lawyers are just the “muscle” for hire…
I am really keen to see which mafia Don wins this one… I wonder if the TMs can survive this modern onslaught. I believe the pendulum is swinging back and they are getting some come uppance…

Well that analysis of property taxes doesn’t work since they are based solely on the value of the home and I think all the money from all real estate in the county goes into the same school system county wide in which I’m sure there are some fine schools and some horrible schools although everyone I know that have children around here, have them in private schools which they have to pay for again.
Beyond Schools, my property taxes also goes to pay for the public hospital. although I pay my own health insurance, and for public transportation and plenty of other services I don’t use.
Anyway not bitching just saying we all pay plenty of money for things we don’t want or need or use.
Back to this particular domain, I don’t think it was essential for Morgan to go out and file this right away in like that they just passed up on getting it for pennies on the dollar, the domain was not in use and I don’t think .PW domains are going to get significant traffic anytime soon.

MORGANSTANLEY.COM is registered with MELBOURNE IT, LTD which is a Brand Protection registrar, its not like its at Godaddy.
So part of a brand protection firm job it to let clients know about things like new domain extensions and I’m sure MELBOURNE IT let their clients know well in advance about .PW and its the client that didn’t move forward.

There’s even a sign on the turnpirke advertising over ‘$65 billion for education” but it doesn’t say schools and kids which is why the total budget for education is 100th of the amount the lottery claims to raise- 65 billion? Of course Brad’s initial assessment is absolutely correct. It’s all going to reach critical mass (this growing protection racket) and when the poop finally hits the fan it won’t be pretty. Personally I think entire registries are the ones who should pay the piper.

Morgan Stanley could very well have ignored this without much consequence. Seriously, who cares about .PW beyond delusional domain speculators or unimaginative types who have given up on all other extensions, including .COM?
The upside though is that it isn’t like this is all in vain for them. They are getting a good measure of publicity that they wouldn’t have gotten if they had simply rolled over and registered the gTLD to begin with. Plus they’re showing how inane this whole charade is.

.COM companies know that the new gTLDs are designed to destroy their Corporate Brand .COM. dominance, they will fight back till the end, and I would not want to be on the gTLD side of this coming battle. Almost does not seem fair, but get ready they are coming for the gTLDs scalps.

Jeff, for someone who claims to be unfazed by the new gtlds, you seem to spend an inordinate amount of time and energy on these boards composing, cutting, and pasting redundant posts.
By the way, companies (brands) and the world for that matter don’t see this as some sort of epic battle between .com and the new gtlds. You need to get some sunlight, maybe take a brisk walk or something. I think in your mind you see yourself as some sort of self appointed leader of the .com special forces. You need to chill my man. If you have strong .com names, you’ll be ok, if they’re marginal, you’re probably screwed as values will decline. That’s been the trend and will continue with the universe of names considered worthy of investment in .com continuing to shrink.
