ICANN Issues Details On New gTLD Prioritization Draw For December 17th

ICANN just released details on the Prioritization Draw (“Draw”) that will be held on 17 December 2012 in Los Angeles to assign priority numbers to all new gTLD applications including the place that the draw will take place.

Each application will be assigned a randomly-drawn priority number.

These priority numbers will be used to determine the order in which initial evaluation results are released.

Only those Applicants who purchase a ticket will be able to participate in the Draw.

Ticket have to be purchased in person, however the applicant does not need to be present at the live draw.

Unlike previous reports the $100 fee does not have to be paid in cash, credit cards and cashiers checks are accepted.

The draw will be broadcast on the web.

Here are the details

The Draw

The Prioritization Draw will be held on 17 December 2012 at the Hilton Los Angeles Airport located at 5711 West Century Blvd, Los Angeles, California, 90045.

The Draw will begin at 1:00 p.m PST, in the International Ballroom and last until approximately 7:00 p.m., or until the last ticket has been drawn and assigned a priority number.

To participate in the Draw, an Applicant, through a designated representative or proxy (see below for more details) must purchase a ticket in person for each application that the Applicant wants prioritized.

Applicants are not required to attend the 17 December 2012 Draw to receive a prioritization number for each application.

Results of the Draw will be announced on the day of the Draw and the results will be posted on ICANN’s website at http://gtldresult.icann.org/application-result/applicationstatus within 24 hours of the end of the Draw.

ICANN reserves the right to revise the date, time, and location of the Draw, as well as the date and time for posting the results of the Draw. If any changes do occur, ICANN will notify all Applicants. Any changes regarding the Draw will be posted to this webpage.

Cost: USD 100.00 per ticket, only one ticket per application is available

Payment: Cash, cashier’s or certified check, travelers cheques, or credit card (Visa, Mastercard, American Express, Discover), payable in U.S. dollars only.

It is strongly encouraged that Applicants purchase tickets in advance of the 17 December 2012 Draw date. A strict cut-off time for ticket sales will be enforced. If an Applicant’s designated representative or proxy is not in the queue to purchase ticket(s) by 11:00 a.m. PST on 17 December 2012, the Applicant forfeits its ability to participate in the Draw.

How to Designate a Representative or Third-Party Proxy

In order to participate in the Draw, Applicants must designate a company representative (any primary or secondary contact, or other person identified on the application) or third-party proxy to purchase a ticket for each Application that the Applicant wants prioritized.

In order to purchase a ticket for one or more applications, an Applicant’s representative or proxy must bring:

  1. a government-issued photo identification containing the name and address/passport number identical to the information provided in the Designation Form; and
  2. the completed Designation Form, including the Application ID number, the applied for string, and the unique Prioritization Draw code (“Code”) that ICANN provides to all Applicants for each application.

The Applicant must inform its designated representative or proxy of these requirements.

Representative-Proxy-Designation-Form

If the Applicant is unable to locate its own proxy, ICANN will provide an “Optional Proxy List” with the names of individuals who will provide proxy services to Applicants at no charge to the Applicants. When available, the list will be posted here.

IF THE NAME AND ADDRESS/PASSPORT NUMBER DO NOT MATCH THOSE LISTED ON THE DESIGNATION FORM, THE REPRESENTATIVE OR PROXY WILL NOT BE ELIGIBLE TO PURCHASE A TICKET.

Charitable Organizations

Proceeds will be donated to eligible California charitable organizations in accordance with California legal requirements.

Hotels & Transportation

Travel and accommodations are the responsibility of the applicant. A small block of rooms is available at the Hilton Los Angeles Airport Hotel at a rate negotiated by ICANN. Use code ICA when making your reservation.

Rooms are available on a first-come, first-served basis.

Rules

By purchasing a ticket for the Draw, the Applicant and its officers, directors, agents, assigns, transferees, attorneys, administrators, employees, predecessors, affiliates, successors, insurers, proxies and representatives agree to abide and be bound by these Official Rules and the decisions of ICANN, which will be final and binding in all respects.

All ticket sales are final, and no payments will be refunded, including payments received from ineligible parties. Tickets and prizes (priority number) may not be exchanged, sold, or transferred by the Applicant, its representative, proxy, or anyone else for use in relation to another application. Each ticket and prize (priority number) is good only for the applicable application. Any attempted transfer, purchase, sale, or auction of a ticket or priority number renders the ticket or priority number void.

Tickets obtained from unauthorized sources are void. ICANN reserves the right to disqualify any Applicant, designated representative or proxy from the Draw, and from the gTLD Application process, if ICANN finds the Applicant, its representative, or proxy to be tampering with the ticket process or the operation of the Draw.

Officers, directors, and staff members of ICANN, their spouses, significant others, parents, children, siblings, and their respective spouses or significant others are excluded from participating as an Applicant’s designated representative or proxy. The same ineligibility rules apply to any organization engaged to provide services to ICANN relating to the Draw.

ICANN reserves the right to reject any request to purchase tickets for any reason not inconsistent with law. All ticket purchases are void where prohibited by law.

Disclosure

By participating in the Draw, all Participants, their representatives and proxies accept and agree that their name, photograph, voice, likeness, image, address (city, state, country), and other indicia of persona may be disclosed to and used by the news media and may otherwise be used by ICANN for publicity purposes without notice or compensation, including but not limited to notices announced or posted on ICANN’s website. These same rules apply to disclosure of all Applicants and the Priority numbers each application receives.

Limitation of Liability

ICANN assumes no responsibility for incomplete, incorrect, or inaccurate information provided by Applicants, their representatives, or their proxies relating to the Draw; for lost, misdirected, late, or non-delivered information relating to a ticket purchase or other failure to timely and validly purchase a ticket; or for failure to notify anyone who attempts to purchase a ticket with a defective or illegible form, government-issued Identification or information or without payment that is valid and complete.

Participants in the Draw (including Applicants and their designated representatives or proxies) assume responsibility for complying with all local, state, federal, international, and other laws. ICANN takes no responsibility for any tax liabilities.

By entering the Draw, each Participant and their designated representative or proxy accept, agree, and consent to be bound by all the rules, limitations, and restrictions set forth in these Rules or elsewhere by ICANN. All Participants and their designated representative or proxy, also accept, agree, and consent that ICANN’s interpretation and application of the Rules shall be final. All Participants, and their designated representative or proxy, agree to waive any right to claim of ambiguity in the Draw or these Official Rules.

All Participants, and their designated representative or proxy, also release and agree to hold harmless ICANN, its officers, directors, employees, agents, and representatives, including any independent organization monitoring or administering the drawing, from any and all liability for injuries, losses, or damages of any kind caused by, resulting from, or relating to participation in the Draw. Each Participant, and their designated representative or proxy, also releases and agrees to hold harmless ICANN, its officers, directors, employees, agents, and representatives, including any independent organization monitoring or administering the drawing, for any and all losses, damages, rights, claims, and actions of any kind arising from, resulting from, or relating to acceptance, possession, receipt, or use of any Priority number chosen.

Applicable Law and Authority

The Draw is intended to be conducted in accordance with applicable California and U.S. laws. By letter from the California Attorney General’s Office, ICANN has registered with the California Department of Justice under Raffle Registration Number RJ0007607 and is authorized to conduct raffles pursuant to Penal Code 320.5 for the raffle period that begins September 1, 2012, and ends August 31, 2013.
