How About Trademark Squatting? Disney Files Trademarks on “Seal Team 6”

May 16, 2011 by Michael Berkens

According to a story in mediabistro.com,  two days after  Seal Team 6 killed Osama bin Laden, Disney applied for a trademark on the term “Seal Team 6″in several classes to cover clothing, toys, games, video games, entertainment and education services.

Of course if a domainer registers a domain after an event they are called cybersqautters and worse.

In the US trademarks are suppose to be registered AFTER use not based on planned or future use.

So unless Disney already had project(s) for Seal Team 6 in the works before the raid, it seems like Disney is doing some squatting of their own.

Same old same old. Big Business streching the rules to fit their desire to make money at the expense of the little guy.

    Nothing new.

This is an “intent to use” trademark filing 1(b).

Navy Seals team 6 could be a trademark of it own. Not sure whether it is allowed to be use by anyone.

I found the website of navy seals stating prohibiting the use of the “Department of the Navy Seal” shown on link page below:

    http://www.navy.mil/navydata/navy_legacy_hr.asp?id=170

“The Navy’s Official Seal…18 United States Code, Part 1, Chapter 47, Section 1017, prohibits the use the Department of the Navy seal, such as that you see on the welcome page of this web site, by anyone other than bona fide commands and activities of the Department of the Navy and the Department of Defense where appropriate.
Secretary of the Navy Instruction 5030.4A of 17 March 1986 restricts the use of the Department of the Navy seal, such as that you see on the welcome page of this web site, to official use only and to the exclusive use of the Department of the Navy and the Department of Defense. Commands can likely obtain a digital copy from the command in their chain of command which has a graphics department.”

Navy Seals becomes a well known name for government organization, not sure the US TRADEMARK department will approve the application of Seal Team 6.

I remember when Navy Seal Team 6 killed Osama, I was planning to reg 8 of Navy Seals related domain names in games and clothings .

I did a quick search for the trademark and found the restriction of use from “…Secretary of the Navy Instruction 5030.4A of 17 March 1986 restricts the use of the Department of the Navy seal, such as that you see on the welcome page of this web site,…”

So I decided not to buy domain names with any words related to Navy Seal Team 6, just for the safe side.

I think the restriction on the use of the navy seal is a different issue than using the words Navy Seal.

Apologies if this is off-topic but “Wow!”.

Gone are the days of Mickey Mouse. lol.

Disney appears to be entering into Mattel territory (GI Joe with the kung-fu grip).

Isn’t Disney, usually confined to themes like kids comedy and teenage romance, etc.? They take great care to avoid violence and sexual themes in their movies.

Perhaps I’m naive and they’ve been doing promoting the military for many years through little known subsidiaries, but this seems strange coming form Disney.

“The USPTO will send a NOTICE OF PUBLICATION to the applicant stating the date of publication. Any party who believes it may be damaged by registration of the mark has thirty (30) days from the publication date to file either an opposition to registration or a request to extend the time to oppose.”

It would be nice if the Navy sent in SEAL Team 6 to personally deliver the notice of opposition by way of inserting it up Bob Igers ass during a predawn raid.

It is discomforting to discover Disney, the supposed family entertainment business, trademarking the name of the seal team that killed the leader of Al Qaeda. It just doesn’t sit well.

Disney hasn’t been about “family entertainment” since Walt croaked.
Hard to really blame them. They changed to accommodate a changed-society, pursuant to the will of the shareholders.
